What Rights Do You Have as a Grandparent?

Unfortunately, your rights may depend on where you live. Not all jurisdictions recognize grandparents' rights. The way the law in Pennsylvania currently stands, there are three ways in which grandparents can obtain visitation or some sort of partial custody of their grandchildren:

  • If the child of the grandparent has died
  • If the parents are divorced or separated for more than six months
  • If the grandchild previously lived with the grandparent for more than a year and was then removed by a parent

While it is assumed that grandparents should be able to see their grandchildren, custodial parents sometimes refuse fair access to children by their non-custodial grandparents.
